Invoicing services from the UK

We have been notified by a company of financial advisers that there are some businesses on the Costa who tempt new customers stating that they would save 16% if they are invoiced from outside Spain. This is not true.

Although invoices from the UK to Spain for services, which include advertising, can be raised without IVA or VAT, the Spanish business MUST declare such invoices on their quarterly IVA return (Modelo 309 – Impuesto sobre el valor añadido) and the IVA is then paid and accounted for in the calculation of payment to the Agencia Tributaria.

Failure to do so could result in a costly mistake and the authorities will charge interest and penalties on top of the tax that should have been accounted for.
