Cleaning Up the Councils for a “Corruption Free” Future

“All the better for a safer property investment on the Costa del Sol” says Des Sparkes LLB.LLM, members of their local Spanish Law Societies and the English Solicitor is also a member of the Law Society of England & Wales.

The recent news of the Spanish Police operation in Estepona Council against corruption and fraud is a natural extension of what was started in Marbella some two to three years ago.

From a legal aspect this “crackdown” is very good, as hopefully it means the beginning of the end to illegal developments in these areas of the Costa del Sol.

This is the type of behaviour that resulted in numerous innocent buyers in Marbella unwittingly purchasing properties which their lawyers thought were legal for having been granted building licences by their local councils. Ironically the previous scandal in Marbella and now the current one in Estepona should actually make things safer for prospective buyers.

Lawyers are now aware that they have to check that properties have been built according to the official area plans created by the regional authority, the Junta de Andalucia and not just accept a building licence issued by the local authority.

Purchasers using good independent Spanish Lawyers (Abogados) and Solicitors who carry out thorough conveyance checks should now be confident that they will not become innocent victims to these types of planning problems in future.

You must always contact a qualified lawyer. It is preferable not to use lawyer recommended by an estate agent or vendor
